The Special Rapporteur's Annual Reports

One of the Special Rapporteur's three main areas of work is to conduct thematic research on issues that have an impact on the human rights situation and the fundamental freedoms of indigenous peoples. These reports are presented once a year to the Human Rights Council (earlier the Commission on Human Rights).

9th report, 2010

Mr. James Anaya's third report to the Human Rights Council was presented at its 15th session in September 2010. It covers a summary of the activities carried out during the second year of his mandate, including cooperation with other international and regional mechanisms in the field of indigenous rights, and the activities carried out in his four principal areas of work: promoting good practices; thematic studies; country reports; and communications relating to alleged human rights violations. The Special Rapporteur devotes the second half of the report to an analysis of corporate responsibility with respect to indigenous rights, in the framework of the international community’s expectations in that regard.

8th report, 2009

Mr. James Anaya's second report to the Human Rights Council was presented at its 12th session in September 2009. It covers the following themes: Coordination with United Nations Permanent Forum on Indigenous Issues and the Expert Mechanism on the Rights of Indigenous Peoples of the Human Rights Council; Analysis of the duty of states to consult with indigenous peoples on matters affecting them: insight into how duty to consult may be addressed by governments, indigenous peoples, the United Nations system, and other stakeholders.

7th report, 2008

Mr. James Anaya's first report to the Human Rights Council, was presented at its 9th session in September 2008 and it provides an analysis of the UN Declaration on the Rights of Indigenous Peoples in the context of other international instruments specifically regarding indigenous peoples and human rights instruments of general applicability.

6th report, 2007

Stavenhagen's 6th annual report to the Human Rights Council, presented at its 4th session, is devoted to presenting the various trends that have affected the situation of the human rights of indigenous peoples during the past 6 years.

At the 4th session of the Council in 2007, Stavenhagen also presented his Study regarding best practices carried out to implement the recommendations contained in the annual reports of the Special Rapporteur.

5th report, 2006

Stavenhagen's 5th annual thematic report, presented at the 62nd session of the Commission on Human Rights, focuses on what has become known as the 'implementation gap' - namely the topics of constitutional reform, legislation and implementation of laws regarding the promotion and protection of the rights of indigenous peoples.

Stavenhagen's 4th annual thematic report, presented at the 61st session of the Commission on Human Rights, focuses on the problems faced by indigenous peoples in education systems, including problems of acess and equity.

Stavenhagen's 3rd thematic annual report, presented at the 60th session of the Commission on Human Rights, focuses on the obstacles, gaps and challenges faced by indigenous peoples in the realm of administration of justice and the relevance of indigenous customary law in national legal systems.

1st report, 2002

In Stavenhagen's first report to the Comission on Human Rights, presented at its 58th session in 2002, he provides a panorama of the main human rights issues besetting indigenous people at the present time, and sets out a framework and agenda for his activities in the future.
